What are the legal steps to take after the death of a loved one?

Losing a loved one can be an overwhelming experience, and handling legal matters during this difficult time may feel stressful. In North Carolina, family members must follow certain legal steps after a person’s death to ensure that the estate is properly managed and that the wishes of the deceased are honored. 

Obtain the death certificate

The first legal step after a death is obtaining a certified copy of the death certificate. You will need this document to handle many legal matters, including notifying financial institutions, insurance companies, and other agencies. You may also need it when filing the deceased’s will with the probate court.

File the will with the probate court

If the deceased had a will, you must file it with the local probate court in the county where the person lived. The court will review the will to determine its validity and appoint a personal representative or executor to handle the estate. If the deceased left no will, the court will appoint an administrator to manage the estate according to North Carolina’s intestacy laws.

Notify creditors and beneficiaries

Settle the estate and distribute assets

After paying debts, the personal representative can settle the estate and distribute remaining assets according to the will or North Carolina’s intestacy laws if there is no will. The probate court will provide oversight throughout the process to ensure you handle everything correctly.
